United Nations .. On the occasion of World Human Rights Day, United Nations Secretary-General Ban Ki-moon demanded the removal of laws that deem homosexuality a crime and said that we need to work for the rights of homosexuals as soon as possible.
Ban said, 'Many countries have modern constitutions in which essential rights and freedoms have been ensured to homosexuals. Despite this, homosexuality is considered a crime in over 70 countries. this is not right. The United Nations General Assembly adopted the Universal Declaration of Human Rights on 10 December 1948. It does not advocate just partial enforcement of human rights. It speaks of equal rights for all people without any discrimination. '
On his recent visit to Africa, the Secretary-General urged the leaders there to abolish the law that considers homosexuality a crime. Ban Ki-moon also managed to save a gay couple from 14 years in captivity in Malawi.
Arch Bishop Bishop Desmond Tutto also spoke at a meeting organized by advocates of lesbian, gay, and trans gender people at the UN headquarters. He compared this fight to the fight against color discrimination in South Africa.
The Honorable Supreme Court delivered a landmark judgment on 6 September 2018. The court said that homosexual tendencies are purely natural biological phenomena. These are not the result of mental deformity, choice or luxury of a person. Therefore, they cannot be classified as any type of crime. Article 377 of the Indian Penal Code (IPC) as unconstitutional, Article -14 (Right to Equality), Article -15 (Prohibition of discrimination on grounds of religion, caste, sex or place of birth), Article-19 (of speech and expression Freedom) and Article 21 (right to life and right to privacy).
This law was added by the then Indian Governor General Lord Macaulay in British India in the year 1861, citing social ethics under Part 377 of the Indian Penal Code. 157 years later, in the year 2018, the Supreme Court of India has declared it irrelevant and unconstitutional and invalid. This is the second time in the Indian judicial system that this law has been declared invalid.
At present there are 25 countries where homosexuals are allowed to marry or where homosexuals are allowed to marry in some states / parts. These are Netherlands, Norway, Belgium, Spain, South Africa, Taiwan, Brazil, Argentina, Colombia, France, Ireland, Iceland, Portugal, Denmark, USA, Germany, Malta, New Zealand, United Kingdom, Mexico, Sweden, Luxembourg, Uruguay , Finland and Canada. The Netherlands was the first country where it was recognized in 2001. The last is Germany and Malta where it was recognized in 2014. Sometimes these are called 'gay marriage' or 'gay marriage'.
Taiwan's parliament has taken a historic decision. Taiwan has become the first country in Asia where gay marriage is no longer illegal.
The conclusion:
The social issues of homosexuals have been constantly ignored in Indian society. There is a happy atmosphere among the people of LGBT community after the Supreme Court verdict. People also believe that after this decision people of such community will get more opportunities to join the mainstream of society. Their fight on other aspects will also be strengthened.
After the Supreme Court's legal recognition of gay sex, it will cease to question whether Article 377 violates the fundamental rights of the Constitution. But even after fighting a long battle to get the right to equality, this community still has to go far to get social recognition.
